Waste Clearance Colliers Wood Terms and Conditions

These Terms and Conditions set out the basis on which we provide waste clearance and related services in and around Colliers Wood. By booking a waste collection, rubbish removal, or associated service with us, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.

1. Definitions

In these Terms and Conditions, the following expressions have the meanings set out below:

1.1 Service means any waste clearance, rubbish removal, collection, loading, transportation, sorting, or disposal service that we provide.

1.2 We, us, and our mean the waste clearance service provider supplying the Service.

1.3 You and your mean the individual, business, or organisation booking or receiving the Service.

1.4 Premises means the property, site, or location where the Service is to be carried out.

1.5 Waste means any materials, items, or goods you ask us to remove as part of the Service, including household, garden, commercial, or construction waste, subject to applicable regulations.

2. Scope of Services

2.1 We provide waste clearance and rubbish removal services within Colliers Wood and surrounding areas. The specific Service to be provided will be agreed with you at the time of booking and confirmed in your booking confirmation.

2.2 We will remove and transport Waste from your Premises to an authorised disposal, recycling, or treatment facility in accordance with applicable UK and local waste management regulations.

2.3 We reserve the right to refuse removal of any items that we reasonably believe are hazardous, illegal, incorrectly described, or unsuitable for collection due to health, safety, or regulatory reasons.

2.4 Our Service does not include cleaning, dismantling of structures, or building work, unless explicitly agreed in writing prior to the booking.

3. Booking Process

3.1 You may request a booking by telephone, email, or via any booking system we make available. A booking is an offer by you to purchase the Service, subject to these Terms and Conditions.

3.2 When you contact us, we may ask for details including but not limited to:

a. Your full name and contact details

b. The address of the Premises

c. Description and estimated volume or weight of Waste

d. Access restrictions, parking information, and any special circumstances at the Premises

3.3 Any quotation we give, whether verbally or in writing, is based on the information you provide. If on arrival we find that the volume, type, or nature of the Waste differs from what was described, or that access is significantly more difficult than stated, we may revise the quotation, refuse to proceed, or agree a new price with you before starting work.

3.4 A booking will be deemed accepted and a contract formed only when we confirm our acceptance and the agreed time and date for the Service, either verbally or in writing.

3.5 We will make reasonable efforts to carry out the Service at the agreed time. However, all dates and times are estimates and may be affected by traffic, weather, and other circumstances beyond our control. We will notify you as soon as reasonably practicable if we anticipate any significant delay.

4. Access and Customer Obligations

4.1 You must ensure that we have safe, reasonable, and timely access to the Premises and to the Waste to be collected. This includes arranging for any necessary parking permits, authorisations, or keys.

4.2 You are responsible for ensuring that the Waste is clearly identified, accessible, and not mixed with items you intend to keep. We will not be liable for removing items that you did not clearly segregate from Waste.

4.3 You warrant that you have full authority and permission to allow us to access the Premises and to remove the Waste. You agree to indemnify us against any claim made by the property owner or any third party arising from our access to the Premises or removal of Waste at your request.

4.4 You must inform us in advance of any known health and safety risks at the Premises, including hazardous materials, structural issues, or aggressive animals.

5. Pricing and Payments

5.1 Our charges are generally based on the volume, weight, type, and handling requirements of the Waste, together with the time and resources needed to complete the Service.

5.2 Any quotation we provide is an estimate only and may be adjusted if on arrival we find that:

a. The quantity or type of Waste is different from that described

b. There are additional access difficulties or delays at the Premises

c. Additional labour, equipment, or time is reasonably required to complete the Service

5.3 Unless otherwise agreed, payment is due immediately on completion of the Service. We may accept payment by cash, credit or debit card, bank transfer, or any other methods we notify to you.

5.4 For business customers, we may at our discretion agree to invoice you after completion of the Service. In such cases, payment is due within the period stated on the invoice. If no period is stated, payment is due within 14 days of the invoice date.

5.5 We reserve the right to charge interest on overdue amounts at the statutory rate permitted under UK law, accruing daily from the due date until payment is received in full.

5.6 All prices are quoted inclusive or exclusive of VAT depending on our VAT status at the time, and we will inform you if VAT applies.

6. Cancellations and Amendments

6.1 You may cancel or reschedule your booking by contacting us as soon as possible.

6.2 If you cancel more than 24 hours before the scheduled arrival time, no cancellation fee will normally be charged.

6.3 If you cancel within 24 hours of the scheduled arrival time, we reserve the right to charge a reasonable cancellation fee to cover our administrative and scheduling costs.

6.4 If we arrive at the Premises at the agreed time and are unable to gain access, or if you are not present where your presence is required, we may treat the booking as cancelled and charge a call-out fee and any reasonable costs incurred.

6.5 We may cancel or postpone the Service if:

a. You fail to provide accurate information or necessary access

b. There are health and safety concerns

c. We are unable to operate due to events beyond our reasonable control

In such cases, we will attempt to rearrange the Service at a mutually convenient time.

7. Waste Regulations and Prohibited Items

7.1 We operate in accordance with applicable UK waste management legislation and regulations. We will transport and dispose of Waste only at authorised sites and will take reasonable steps to ensure compliance with all relevant legal requirements.

7.2 You must not present for collection any Waste that is prohibited by law or that we are not licensed or equipped to handle. This may include, but is not limited to:

a. Asbestos or asbestos-containing materials

b. Clinical or medical waste

c. Corrosive, flammable, explosive, or toxic substances

d. Gas cylinders and pressurised containers

e. Certain types of chemicals, oils, or solvents

7.3 If you provide such prohibited items without notifying us in advance, we may refuse to remove them, or if they are discovered after loading, we may return them to you or arrange specialist handling at your cost.

7.4 You are responsible for accurately describing the Waste and for segregating hazardous materials from general Waste. You agree to indemnify us against any losses, fines, or liabilities arising from your failure to comply with relevant waste regulations or to provide accurate information.

8. Liability and Damage

8.1 We will exercise reasonable care and skill in providing the Service. However, we will not be liable for any damage caused by the condition or inherent defects of the Premises, existing structural weaknesses, or normal wear and tear linked to the removal of Waste.

8.2 You should move or protect any delicate, high-value, or fragile items near the collection area. We will not be responsible for accidental damage to such items unless caused by our negligence.

8.3 Our liability for any loss or damage arising from the Service is limited to the direct cost of repair or replacement of the affected property, and in any event shall not exceed the fee paid or payable for the Service on the date of the incident.

8.4 We will not be liable for any indirect or consequential loss, loss of profit, loss of business, or loss of opportunity arising out of or in connection with the Service or these Terms and Conditions.

8.5 Nothing in these Terms and Conditions shall limit or exclude our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot lawfully be limited or excluded under UK law.

9. Insurance

9.1 We will maintain appropriate public liability insurance and, where applicable, employer's liability insurance in connection with the provision of the Service.

9.2 Details of our insurance cover are available upon reasonable request.

10. Complaints and Disputes

10.1 If you are dissatisfied with any aspect of the Service, you should notify us as soon as possible, providing full details of the issue.

10.2 We will investigate your complaint and, where appropriate, propose a remedy such as partial refund, re-attendance, or other corrective action, subject to these Terms and Conditions.

10.3 If a dispute cannot be resolved directly between us, either party may seek to resolve the matter through mediation or through the courts, as appropriate.

11. Data Protection and Privacy

11.1 We will collect and use your personal data only for the purposes of managing your booking, providing the Service, handling payments, and communicating with you in relation to our services.

11.2 We will take reasonable steps to keep your personal data secure and will not sell or share your information with third parties except where necessary to provide the Service, comply with legal obligations, or where you have given your consent.

12. Events Beyond Our Control

12.1 We will not be in breach of these Terms and Conditions or otherwise liable for any delay in performance or failure to perform any of our obligations where such delay or failure results from events or circumstances beyond our reasonable control.

12.2 Such events may include, but are not limited to, extreme weather, traffic disruption, accidents, strikes, acts of government, pandemics, or failures of utilities or transportation networks.

13. Changes to These Terms

13.1 We may update or amend these Terms and Conditions from time to time to reflect changes in law, best practice, or the way we operate our waste clearance services.

13.2 The version of the Terms and Conditions in force at the time of your booking will apply to the Service provided under that booking.

14. Governing Law and Jurisdiction

14.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Service, shall be governed by and construed in accordance with the laws of England and Wales.

14.2 You and we agree that the courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Service.

15. Severability

15.1 If any provision of these Terms and Conditions is found by a court or other competent authority to be invalid, illegal, or unenforceable, that provision shall be deemed deleted, but the remaining provisions shall continue in full force and effect.

16. Entire Agreement

16.1 These Terms and Conditions constitute the entire agreement between you and us in relation to the Service and supersede any prior understandings or agreements, whether oral or written.

16.2 You acknowledge that you have not relied on any statement, promise, or representation made or given by or on behalf of us that is not set out in these Terms and Conditions.
